【摘要】 传统的过失认定标准,大陆法系为"善良家父",英美法系为"理性人";随着法经济学分析方法的引入,汉德公式标准应运而生,可以认为是过失认定标准的进化,但依然存在量化困境。根据间主观性理论,传统标准和汉德公式标准统一于主客观连续统,传统标准客观性较弱而非纯主观,汉德公式客观性较强但非纯客观,故难以量化实属必然。为在一定程度上消解此困境,在假定原始汉德公式具有准确概率N之基础上,提出包括四个命题的"修正的汉德公式"。更多还原

【Abstract】 According to the traditional standard of negligence determination,the Civil Law System adopts the kind-hearted Father Criterion while the Common Law System adopts the Reasonable Persons Criterion. The Hand Formula has been created with the development of the analytic techniques of Economics of Law. It is considered to be the evolution of the standard of negligence determination,but in the meantime difficult to quantify. According to the Inter-subjectivity theory,the traditional standard and the Hand Formula are unified in the subjective-objective continuum. The traditional standard has a relatively weaker objectivity without being purely subjective while the Hand Formula has a stronger objectivity without being purely objective,so the difficulty in quantification is inevitable. In order to solve the dilemma,the Modified Hand Formula including four propositions is proposed based on the assumption that the original Hand Formula would have a correct probability of N.更多还原
