【摘要】 成年人监护的对象主要是老年人和精神障碍者,这两个群体虽有交叉,但有明显区别,所以成年人监护制度对这两个群体的保护措施有所不同,指导思想也不尽相同。对于有完全行为能力的老年人而言,主要以意定监护制度进行保护,以自主决策作为指导思想。对于有部分行为能力的精神障碍者则以辅助制度进行保护,以支持决策作为指导思想。对于没有行为能力的老年人及精神障碍者则以监护制度进行保护,以替代决策作为指导思想。中国正处于《民法典》编纂过程中,成年人监护制度作为民法的重要制度,在完善制度设计时应体现上述特点。更多还原

【Abstract】 The object of adult guardianship is mainly the elderly and people with mental disabilities.Although these two groups have crossed,but have obvious difference. So the adult guardianship systems use different protection measures and guiding ideologies to protect these two groups. The elderly suffering from complete behavioral disabilities are protected by the arbitrary custody system and the guiding ideology is self-decision-making. People with mental disabilities who have some behavioral skills are protected by a system of assistance,enjoying supported decision-making as a guiding ideology. For the elderly and those with mental disabilities who do not have the ability to act,the guardianship system should protect them,with substituted decision making as a guiding ideology. China is in the process of codification of civil codes,with the adult guardianship system forming an important part of the civil law,which should embody the above characteristics in perfecting the system design.更多还原
