【摘要】 CPTPP投资规则除了搁置有关投资协议、投资授权的定义和投资者国家争端解决机制外,几乎全盘接受了其前身TPP的投资条款。虽然CPTPP投资自由化标准不及TPP,但仍不失为"全面且进步"的高标准投资规则,且由于其对其他国家和独立关税区的开放性,该协定的未来影响力不容小觑。中国作为世界外商投资的重要接受国和来源国,亟需根据国际投资环境、国内吸引外资和对外投资需求调整自身相关政策和措施,以便为中国经济的持续增长和转型升级保驾护航。本文通过分析比较CPTPP与TPP的异同,以及CPTPP与其他贸易或投资协定中的投资规则的异同,试图得出世界投资规则的发展趋势,中国在投资规则方面的基本立场,以及CPTPP对中国外资政策制定和完善的可能启示。更多还原

【Abstract】 The investment chapter of CPTPP accepts almost all articles of TPP,its predecessor, except for the definitions and some contents of the articles of ISDS(Investor-State Dispute Settlement) relating to the Investment Agreement and Investment Authorisation. With lower investment liberalization standards than TPP, the CPTPP investment chapter is however nothing short of a high-standard international investment rule, and its openness to other countries and separate customs territories means it may have a great impact on the world in the future. As an important host country and home country of FDI, China needs to change its related policies and measures in light of the international investment situations and China’s needs in FDI and ODI, to promote sustained economic growth and to succeed in economic transformation and upgrading. Based on the comparison of the international investment rules between CPTPP and TPP and other FTAs or BITs, this paper tries to analyze the trends of international investment rules and China’s basic position in order to get some enlightenment of CPTPP on China’s foreign investment policies and other related policies.更多还原
