【摘要】 借鉴布迪厄的反身社会学思路和哈贝马斯对生活世界殖民化的分析,对性暴力的社会学研究进行了考察。研究发现,性暴力的概念构成具有明显的法理化烙印;在性意愿的维度上强调"同意"而忽视"需要";在性意愿的分类上强调"二元"而忽视"连续体"。法律逻辑的主导地位源于社会的法治化及法学地位的上升。为了突破法律逻辑的主导地位的限制,性暴力的社会学研究需要考察性暴力的日常知识与应对实践,把法律逻辑所排除的内容重新纳入视野。更多还原

【Abstract】 Drawing on the experience of Bourdieu’s ideas on reflexive sociology and Habermas’ s analysis on the colonization of life world,this paper explores the sociological research on sexual violence.According to the findings, the conceptual constitution of sexual violence has obvious imprint of juridification. Regarding the dimension of sexual willingness,it would empharize the"consent"and ingore the"need". As for the classification of sexual willingness,it would empharize the"duality"and ignore the"continuum". The dominant position of legal logic originates from the juridification in society and the rising status of law. In order to break through the restriction of the dominat position of legal logic,the sociological research on sexual violence should examine the daily knowledge of sexual violence and its coping practice,and bring the contents excluded by legal logic into our horizon again.更多还原
