【摘要】 当前,我国司法体制改革进入攻坚期和深水区,国家监察体制改革试点也已在全国全面铺开,检察机关面临着职能重大调整、检察工作亟待转型发展等问题。针对当前检察权运行机制中所出现的一系列新问题,既需要进行自上而下的顶层设计,又需要来自制度实践的经验参考。在检察机制运行中,检察权与检察职能作为互动链条中的关键枢纽,对于当前司法体制改革的推进起着极为重要的作用。纵观我国检察机制发展脉络,横较世界各国检察权运行发展趋势,我国当前在检察职能主体思维模式、本质属性定位、具体内容分类、内外联动性等方面还存在不同程度的问题,严重影响了检察权独立、高效运行。特别是在国家司法体制、监察体制改革背景下,应当及时调整和转变检察职能视角,主动明晰检察职能新定位,创新检察权运行机制,营造新型检察权运行环境,使检察职能更好地聚焦于法律监督,助推国家司法体制改革走向成功。更多还原

【Abstract】 Currently,China’s judicial reform has entered into a crucial stage when pilot reform of the national supervision system has been spread across the country,so procuratorial agencies are faced with significant function adjustments and transformational development. To address a series of new problems aroused in the new operational mechanism of prosecutorial power,not only top-down policy should be designed,but also the experience from system practice ought to be referred to. In the operation of procuratorial mechanism,procuratorial power and procuratorial function are the key hubs in its interactive chain,which plays an important role in the progress of the current judicial reform. Reviewing both the development of China’s procuratorial system and worldwide development trends of prosecutorial power’s operation,there exist problems of different degrees in the main mode of thinking,the essential attribute’s positioning,specific contend classification,and internal and external linkage,seriously affecting the independent and efficient operation of procuratorial power. Especially in the context of the reform of the national judicial system and supervision system,it is necessary to timely adjust and transform the perspective of procuratorial functions,and take the initiative to clarify the new positioning of procuratorial functions. Therefore,we should innovate the operation mechanism of procuratorial power and create a new type of procuratorial power operation environment so as to focus on legal supervision and promote the success of the reform of the national judicial system.更多还原
