【摘要】 关于政府和社会资本方相对PPP项目所享有的物权关系一直存在较多争议,制度建构通常以政府和社会资本的二元权益关系为基础。但这种二元体系很容易造成公共资产管理过程中社会权益的缺失,从而削弱了制度合法性及其有效性。借鉴公共信托思想构建PPP模式的物权基础,分析基于公共信托的PPP权利束特点,进而构建基于公共信托的PPP三元双层用益权体系,为进一步构建多元主体的权益保护制度、破除PPP治理障碍提供了一个新的视角。更多还原

【Abstract】 There has been a lot of controversy about the real right relationship of PPP projects between government and social capital. The system establishment of PPP mode is generally based on the binary rights and interests of the government and social capital. But this kind of binary system design can easily cause the absence of social interests in the management of public assets,which undermines its legitimacy and effectiveness. This paper introduces public trust into the PPP model,analyzes PPP bundle of rights features based on public trust and finally constructs the ternary bilayer usufruct design system,which provides a new perspective for constructing the protection system of rights and interests of multiple subjects and remove the obstacles of PPP governance.更多还原
