【摘要】 担保义务的履行对于国际海底区域的资源开发及环境保护具有重大意义。对担保义务的研究需要通过运用语义分析、逻辑分析、比较研究等方法,以《联合国海洋法公约》及相关立法为依据,结合国际海洋法庭海底争端分庭就担保国义务问题所发表的咨询意见,对国际海底区域担保义务的性质、内容、履行等问题展开论证。担保义务属于行为义务,担保国应该通过制定法律、规章及采取行政措施以确保其对担保义务的履行达到"勤勉"程度;鉴于发达国家与发展中国家在履行担保义务能力方面的差距,应给予它们有条件的差别待遇,以鼓励发展中国家加强能力建设,更好地平等参与"区域"活动。更多还原

【Abstract】 The fulfillment of the obligation of guarantor is of great significance to development of resources and environmental protection in the international seabed area.In this paper,using semantic analysis,logical analysis,comparative research,and the United Nations Convention on the Law of the Sea and relevant legislation as basis,combined with the advice from International Tribunal for the Seabed Dispute Chamber of the obligations of the guarantor on the international seabed security,we discussed the nature of obligation,content,form of performance and performance differences between different countries.Through the analysis,it is pointed out that the guarantee obligation belongs to the obligation of conduct,and the guarantor shall adopt the laws and regulations and take administrative measures to ensure that the performance of the guarantee obligation is"diligent".In view of the gaps of developed and developing countries fulfilling their guarantee obligations,conditional differential treatment should be given to encourage developing countries to strengthen capacity-building and participate more effectively in"The Area"activities.In the analysis of the above related issues,submarine dispute on the Advisory Committee of the many deficiencies were analyzed in order to clarify the relevant concepts to get a better understanding of its content,which will further regulate and guide activities in"The Area".更多还原
