【摘要】 先秦法家法制思想影响了后世法律进程,法制社会的发展需要借鉴古人经验,来鉴证当代社会的法制进程。从法律的实质、形式、适用等多重角度,分析先秦法家法制思想对当代法制社会发展的参照价值,希望以史为鉴,推动我国社会的法制进程,与时俱进、维护社会公平、促进执法层面的严明,考量重刑对于社会发展的弊端,延续法家"执法必信、司法必平"的法制思想,与时代接轨。更多还原

【Abstract】 Legalists’ legal thoughts in the pre-Qin period in?uence the legal process of later generations. The development of legal society needs to learn from the ancients’ experience to verify the legal process in contemporary society. This paper analyzes, from the perspectives of the essence,form and application of law, the reference value of legalists’ legal thoughts in the pre-Qin period to the development of contemporary legal society.It is hoped that we can learn from the history, promote the legal process of our society, advance with the times, maintain social fairness, and promote the strictness of law enforcement. In the meanwhile, we should consider the drawbacks of heavy punishment for social development, should continue the legal thought of "enforcing the compelling law and ensuring the fair justice", and should be in line with the times.更多还原
