【摘要】 "思想表达二分法",目前已经成为世界通用的判定著作权侵权的重要原则,但是由于思想与表达在作品中常常难以区分,这导致了司法实践中关于"思想表达二分法"原则的具体运用具有复杂性,尤其在文学作品中的运用最为典型,也最为复杂。文学作品中思想与表达的界限是模糊不清的,具有独创性的内容,也即独创性的表达也应该纳入表达范畴;"思想表达二分法"在文学作品侵权判定中的适用是需要先适用独创性的标准,并排除思想表达混同等因素后,继而运用整体比对法与部分比对法相结合的方法进行实质性相似的判定。"思想表达二分法"在文学作品相似侵权判定中的具体适用步骤:首先,必须重新界定思想与表达的界限,运用经典的"抽象测试法"划分文学作品中思想与表达的界限,始终抓住著作权法保护的本质——独创性表达这一核心概念;其次,根据上一步骤所划分的界限,重点适用"三步检验法"对两部作品进行比对,继而适用"整体概念和感受法"从整体上进行测试。更多还原

【Abstract】 The"idea/expression dichotomy"has now become an important principle universally applied in judgments of copyright infringement.However,it is often difficult to distinguish idea from expression in works,leading to the complexity in specific application of the principle of"idea/expression dichotomy"in judicial practice,especially in literary works.The boundaries of idea and expression in literary works are ambiguous and the original content,i.e.the original expression should also be included in the category of expression.As for the application of"idea/expression dichotomy"in the judgment of infringement of literary works,the originality standards should be first adopted,and the ideological confusion and other factors should be excluded,and then the judgment of substantial similarity can be made by using the overall comparison method and the partial comparison method.The procedure of applying"idea/expression dichotomy"in literary works is presented.Firstly,the boundaries of idea and expression should be redefined.The boundaries of idea and expression in literary works can be classified by using the classic abstract test method,and the core concept of original ex-pression,which is the essence of the protection of copyright law,should be always considered.Secondly,based on the redefined boundaries,two works are compared by applying the three-step test method,and then the overall test is made by applying the overall concept and feeling method.更多还原
