改革开放四十年教育立法的经验和问题
Historical Experience and Existing Problems of Educational Legislation since Reform and Opening-Up
【摘要】 改革开放四十年教育立法的经验主要包括坚持正确的指导思想;实事求是,从实际出发;统筹兼顾,合理调节教育关系;依法立法,注意教育法律规范的体系性和统一性;民主立法,集思广益。改革开放四十年教育立法的问题:对教育不平衡发展的矛盾反映不够充分,推动解决不够有力;没有把握好立法的界限和节奏;立法条款确定性不高,可操作性较差;疏于倾听受教育者的意见和建议;对立法评估不够重视。教育立法的进一步发展和完善,需要总结和传承经验,剖析和解决问题。
【Abstract】 Since the reform and opening up, the historical experience of educational legislation can be summed up as follows: adhering to the correct guiding thoughts; seeking truth from facts and starting from reality; taking all factors into consideration and rationally regulating the relationship of interests; making legislation in accordance with the law, paying attention to the system and logic of the legal norms of education; making legislation in a democratic manner. The main existing problems are as follows: not fully paying attention to the problem of the unbalanced development of education, and the solution is not strong enough; the limits and rhythm of the legislation are not well grasped; the certainty of the legislative provisions is not high and the operability is poor; neglecting to listen to the opinions and suggestions of the educated; the evaluation of the law is not paid enough attention. The further development and perfection of educational legislation need to summarize and inherit historical experience, and analyze and solve existing problems.
