【Abstract】 Since the reform and opening up, the historical experience of educational legislation can be summed up as follows: adhering to the correct guiding thoughts; seeking truth from facts and starting from reality; taking all factors into consideration and rationally regulating the relationship of interests; making legislation in accordance with the law, paying attention to the system and logic of the legal norms of education; making legislation in a democratic manner. The main existing problems are as follows: not fully paying attention to the problem of the unbalanced development of education, and the solution is not strong enough; the limits and rhythm of the legislation are not well grasped; the certainty of the legislative provisions is not high and the operability is poor; neglecting to listen to the opinions and suggestions of the educated; the evaluation of the law is not paid enough attention.
