【摘要】 城市管理综合执法人员作为一类"街头官僚"群体,既是城市治理和公共政策的具体执行者,又是与基层民众联系最紧密的公务人员,其行政执法行为既直接影响政府政策目标的实现,又切实影响民众福祉,成为公众眼中"政府形象"的重要构成。本文立足于对我国城市管理综合执法人员开展的两个月田野调查和对美国地方政府城市管理执法的比较,在对以往相关研究进行综述的基础上,对目前解决城管问题的各种讨论进行了总结和反思,形成了我国城管问题的解决出路在于"职业化"的新观点。文章基于职业化定位视角对中美街头官僚进行的比较分析,从历史和制度层面探究造成中美差异化的根源,提出要在推进全面法治的前提下,修正城管责任定位,明确城管职业化方向,依法构建城管职业规范,重塑职业化的城管队伍,这是城管队伍从自身做起,突破当前我国城市管理综合执法困境的切实途径。更多还原

【Abstract】 Code enforcement officers,defined as the street level bureaucracy,not only execute public policies, but also have the close contact with residents, and their actions decide whether public policies can reach their intended goals and affect the welfare of the public. The street level bureaucracy represents the image of the government. Based on the data collected through a two-month long field study and a study conducted in an American local government, this comparative study focuses on issues emerged from code enforcement operations and arrives at some conclusions, offering new approaches that help professionalize code enforcement. Started with historical and institutional perspectives, this comparative study examines the differences between the two countries in regards to the code enforcement operations, and argues that the path for improving the quality of the current code enforcement operations in China is to adjust the responsibility, clearly define the professional path, and create operation standards for code enforcement profession. Building a code enforcement profession is a viable solution to improve the code enforcement operations.更多还原
