【摘要】 探索实行重大监督事项案件化办理,是最高人民检察院"十三五"规划中的重要内容。重大事项应该按照比例原则,根据违法情形的严重程度来确定,在侦查监督、刑事审判监督、刑事执行监督、民事诉讼监督、行政诉讼监督、公益诉讼等领域内,作为案件,按照统一的证据标准和程序来办理。这有利于推进检察机关聚焦监督主责主业,有利于提升检察监督工作法治化水平,有利于推进法治国家建设。重大监督事项案件化需要建立一套科学体系化的制度,应制定专门的检察监督法律法规、明确监督案件的案由与监督标准、制定完备的检察监督程序、提供监督案件办案机构专门化的组织保障和信息化支撑。更多还原

【Abstract】 Exploring the implementation of dealing with major supervisory matters as handling cases is an important part of the ‘13 th Five-Year Plan’of China’s Supreme People’s Procuratorate. Major issues should be determined based on the principle of proportionality and the severity of the illegal situation. In areas such as investigation supervision,criminal trial supervision,criminal enforcement supervision,civil litigation supervision,administrative litigation supervision,public interest litigation,etc.,major issues should be handled in accordance with unified evidence standards and procedures,which is of great meaning in advancing the procuratorial organs focus on supervisory responsibilities and promoting our country’s law construction. The case-making of major supervisory matters needs to establish a scientific and systematic system.Such as the special procuratorial supervisory laws and regulations,a clear supervisory cause and standards,the procedures for the supervision of the case. In addition,it is necessary to provide organizational guarantee and information support for the agencies which are handling supervisory cases.更多还原
