【摘要】 从中华人民共和国成立初期至今,我国刑法有了很大的发展变化,其中,与经济犯罪相关的罪名和刑罚的变化甚多,这与我国刑事政策的变化、社会经济的发展以及立法水平的提高密不可分。对经济类违法犯罪行为的惩罚,一直是我国刑事立法的重点之一,从1951年的《妨碍国家货币治罪暂行条例》开始,我国陆续出台了多个以维护金融秩序、经济发展,打击经济犯罪为目的的法律法规,其中仅刑事法规就有近30个之多。纵观包括刑法典相关章节在内的刑事法律法规,我国经济犯罪的立法规制与时俱进,体现了鲜明的时代特征和社会背景,比如,投机倒把罪从设立到废除,死刑在经济犯罪上的适用由多至少,等等,都反映了立法者对经济发展要求法律保障的回应和对刑法适用的反思。我国对经济犯罪的刑事规制应当采取刑法典+附属刑法的二元论立法模式,并重视判例的辅助作用。更多还原

【Abstract】 Since the early days of the founding of the People’s Republic of China,there have been great changes in china’s criminal law,among which the crime and penalty of economic crimes have changed a lot,which is closely related to the variation of criminal policy,development of social economy and improvement of legislation level.The punishment of economic crimes is always a key point of criminal legislation in our country.Starting from the Interim Regulations on Punishment for Impairment of State Currency in 1951,we have promulgated several laws and regulations which aim to maintain financial order,economic development and economic crime,until now,there are nearly 30 criminal laws and Regulations.Throughout the laws and regulations,including the relevant chapters of the penal code,the legislative regulations of economic crime in our country keep pace with the times,which embody the distinctive characteristics of the times and the social background,such as the establishment and abolishment of speculation crime,the increase and decrease of application of death penalty in economic crime,all which reflect the legislators’response to the demand for legal protection ineconomic development and the reflection on the application of criminal law.China’s Criminal regulation of economic crime should take the dual legislative model (Penal Code+ affiliated criminal law),and attach importance to the auxiliary role of judicial precedent.更多还原
