【摘要】 研究目的:在中国特有的土地权属和利用制度下,界定土壤污染修复责任的状态责任人和合理的义务人。研究方法:比较研究。研究结果:(1)土壤污染修复包含污染行为和责任人两要素。土地使用人、土地所有人及污染土壤有事实管控力的主体应当承担状态责任;(2)在多数状态责任人同时存在时,应根据比例和有效原则,选择某一主体承担土壤污染修复责任;(3)在行为责任人与状态责任人并存时,应优先考虑行为责任人作为土壤污染修复责任主体。研究结论:行为责任人应当首顺位承担土壤污染修复责任的承担;状态责任人应当按照受益者负担的原则承担次顺位责任;政府承担公法上的环境治理义务。更多还原

【Abstract】 The purpose of this paper is to identify the state responsible parties of soil pollution remediation and the resonable obligated person, given the unique land ownership and utilization system in our country. The Method used is comparative analysis. The results show that: 1)Soil pollution remediation contains two elements, i.e., "soil pollution" and "remediation", for which the land user, the land owner and the subject who have control capabilities on contaminated soil should be responsible; 2)the situation where multiple persons should be responsible for the action, the responsibilities should be clarified according to the proportions and the effective principle; 3)behavior responsiblity parties should be given the priority to bear the responsibility for soil pollution remediation when most behavior responsible parties and state responsible parties coexist. In conclusion,the behavior responsiblity person should bear the first pick of soil remediation liability; the state responsibility should be liable for subordinated liability in accordance with the principle of beneficiary pay; the government should bear the supplementary liability.更多还原
