【摘要】 如何平衡保密与公开之间的冲突,是各国保密发明或者专利制度需要解决的重要问题。美国建立了规范保密命令颁发条件、审查程序、分类管理和政府利益登记等制度。它不仅使美国保密发明数量长期维持在一个稳定状态,而且有利于保密发明的有效运用。为了实施军民融合发展战略,我国可借鉴美国保密发明审查机制,对国防专利分类管理并对国家享有利益进行登记。更多还原

【Abstract】 It is an important issue needing to be resolved how to balance the confl ict between secrecy and disclosure in patent system. The U.S. has established a perfect mechanism system, including the requirement of issuingsecrecy orders, examining procedure, the register on government interest and the categories of secrecy orders, to examine the secrecy inventions. It is benefit for keeping the number stabilityof secrecy orders and also can improve the utilization of secrecy inventions. To implement the strategy of Civil-military integration development, we can take example by the practice of the classifi cation management relating to secrecy orders, the register on government interest in the U.S.A.更多还原
