【Abstract】 The introduction of modern legal concepts to land rights,especially those concerning property rights,brings insight into the complexity of land rights while at the same time induces complication and confusion in certain terms. Based on private land market and its transaction practices in traditional China,the author proposes the "land rights — land price or land rent"frame in the explanation of land rights.Transaction related parties who acquire part or all of the land price or land rent will be considered as the owners of partial or full land rights. The division of land rights will not be permanent and thoroughly,while the division ratios of different land rights are consistent with respective land price ratio. The author also analyses in detail various land rights transaction forms such as Dian( conditional sale) and Yazu( depositrequired land tenancy),as well as the division and transfer of land rights.更多还原
