【摘要】 依照传统思维和实践路径,党内法规备案审查制度仅限于"党内"备案审查的一元运作系统,以及"主动"审查的一维模式。但是中国共产党是长期执政的执政党与领导党,基于法治国家建成的通盘考量,传统的"一元一维"路径已经无法满足党科学执政、民主执政、依法执政的需要,党内法规必须纳入法治的运行轨道。建构"二元双维"党内法规备案审查制度,即由"内审单元"(党内备案审查)与"外审单元"(联动备案审查)并行之二元机制、"主动审查"与"被动审查"齐举之双维模式共同构成的新型备案审查制度,能有效消弭党规与国法之间的张力,补强党在法治话语下执政权与领导权的正当性,并最终提高党的公信力、改善党的执政能力、提升党的领导能力,助益法治国家的建设。更多还原

【Abstract】 According to the traditional thinking and practice path,regulations of the party filing and examination system shall be limited to one unit party operation system and taking the initiative to review the single dimensional model. But Communist Party of China is the leading party and the long ruling party. Based on the overall consideration about building the country under rule of law,the traditional one- unit and one- dimensional path has been unable to meet the scientific,democratic and law- based governance needs of the party,and party law must be placed in the orbit of the rule of law. The construction of the internal audit unit party record review and external audit unit record review of two unit linkage mechanism,the initiative to review the record review system and review of laws and regulations of the party launched two dimensional dynamic,can effectively bridge the gap between the party and state law,strengthen Party leadership and the legitimacy of the regime in the rule of law discourse,and ultimately improve the credibility of the party,the ruling ability of the party,and the leadership of the party,and finally to build a solid foundation for the country under rule of law.更多还原
