【摘要】 中国人权法学研究呈现由译介述评向本土叙事、由权利正当性论证向权利释义学、由一般性权利论证向具体权利证成等转向趋势,中国问题意识在这一过程中日益凸显。人权法学研究应当从问题出发,为问题的解决提供开放性的、多元化的智识指引,要有效防方法论上的独断,从中国人权体系抑或基本权利体系的价值信仰出发,促进中国人权抑或基本权利作业范式的形成。更多还原

【Abstract】 The transformation of the Human Rights Law research in China indicates a trend from the translations of western work to the resolutions of local problems,from the justifications of rights to the interpretations of rights,and from the general rights to the specific rights.During the process,the problem consciousness of China’s issue is increasingly growing.The research achievements should provide multiple methods for reality problems’ resolution and prevent the methodology arbitrariness.And with a starting point from the values of China human rights or basic rights system,the human rights research could promote the development of the operation models of China human rights or basic rights.更多还原
