国家监察委员会职权的立法配置与逻辑思考

【摘要】 国家监察委员会的设立是腐败治理"中国模式"在完善与发展中实现由治标转向治本、由被动转为主动、由分散走向整合的一项重大体制与机制创新。国家监察委员会全面履行与优化腐败治理能力的关键在于监察委员会的职权配置及运行机制的立法设计。现行监察委员会试点改革方案在职权配置上存在闭合系统与博弈失势上的理论障碍,监督、调查、处置的三权运行设计尚缺乏整体性的权力指导与反馈性的权力依托支撑。借鉴监察制度发达国家与地区建构完整监察职权体系的有益经验,应当在正式的国家监察法中将立法建议权与策略制定权配置于国家监察委员会的职权体系。

【Abstract】 The establishment of the national supervision commission represents a major institutional and mechanism innovation for perfecting the China Mode of fighting corruption,from a temporary solution to a permanent cure,from passive to active,and from decentralization to integration. The key for comprehensively carrying out anti-corruption and maximizing its effectiveness lies in authority collocation within the national supervision commission setup together with sets of corresponding legislative mechanism design. The current pilot reform program is still riddled with a closed system in terms of authority collocation and theoretical handicaps of a losing game,with neither comprehensive guidelines nor feedback supporting systems for coordinating the tripartite power design of supervision,investigation and disposition. This paper proposes borrowing from the successful experience of developed countries in subjugating the authority of supervision proposal for legislation and policy-making within the overall authority setup of the national supervision commission.
