【摘要】 境外追逃和境外追赃是中国惩治腐败执法合作的两个重要环节,反腐败工作要得到突破和创新,必须明确国际合作的重点,即境外追赃,必须改变原本以"追逃"为核心的合作机制,应以"追赃"为导向,追逃追赃并重,注重对外逃犯罪经济上的剥夺。目前,中国的追赃工作仍处于起步阶段,在寻求他国对追赃问题的司法协助中应当对关系其中的政治因素和法律因素进行全盘考量,通过友好协商和对等原则达成平等互惠的追赃合约。同时,必须正视在反腐败执法机制中所面临的困境。首先,追赃问题关系到巨大的经济利益,为调动起有关国家的积极性,建立和落实资产返还和分享机制能够有效地缓解其中的利益冲突。其次,各国不同的法律制度为追赃问题的司法合作带来了困难,要适应国际公约,需要启动配套法律修改程序,可谓牵一发而动全身,借鉴《联合国反腐败国际公约》规定,利用民法途径解决相关追赃问题未尝不是一个新突破。再次,网络时代给中国甚至全球的反腐败工作带来了新的挑战,但也为追赃工作的国际合作提供了一个新思路,利用大数据技术建立全国性的信用机制能够实现对洗钱活动的监管,同时鼓励国家之间搭建信息交换平台和赃款追缴情报交流,实现国家之间的实时信息交流和司法协助,使境外追逃追赃工作达到事半功倍的效果。更多还原

【Abstract】 To capture escaped criminals and recover booty overseas are two important aspects in the cooperation of law enforcement against corruption in China. In order to get breakthrough and innovation in the future anti-corruption,the key point of international cooperation,booty recovery overseas,must be realized and the economic deprivation of escaped criminals must be valued. China’s booty recovery is still in the starting phase. In the process of seeking judicial assistance from other countries,China should have friendly negotiation with them and follow the principle of reciprocity to reach an equal and mutual-beneficial agreement on booty recovery. Meanwhile,the dilemma confronted in the law enforcement of anti-corruption must be envisaged.The establishment of nationwide credit mechanism with the help of big data technique and of information exchange platform among countries will be helpful for the international cooperation of booty recovery.更多还原
