【摘要】 调解与判决是人民法院审理民事案件的两种重要的结案方式。从成本角度分析,调解与判决具有不同的成本。在对二者成本进行较为全面的比较的基础上,分析了法官偏好调解的主要原因以及调解制度存在的主要问题。针对诉讼成本控制与民事司法程序改革,适度强化案件审结期限对于法院和法官的约束、严格控制法院调解的适用场合、建立替代纠纷解决机制。更多还原

【Abstract】 Mediation and adjudication are the two important ways to end a case in dealing with civil cases at people’s court.Analyzed from the angle of cost,mediation and adjudication have different costs.On the basis of the general comparison of their costs,the thesis analyzes the main reasons of preference mediation of judges and the main problems existing in mediation system.Aiming at the control of lawsuit cost and the reform of civil judicial procedure,the paper brings forward some tentative plans,such as tightening the restrictions of case inquisition deadline towards the court and judges within measure,strict control of the suitable occasion of court mediation,creating lawsuit procedures of small amount of money,establishing the institutes and systems to substitute the settlement of dissensions.更多还原
