【Abstract】 In recent years, online taxi-hailing have been developing rapidly in China, and the drivers of online taxi-hailing is the main body of this new business economic activity. While exercising their labor rights, part of the drivers of online taxi——hailing-the social vehicle drivers are often trapped in the imperfect law.Their right of independent employment and equal employment rights are difficult to realize, the right to rest and leave is difficult to guarantee, the labor remuneration is difficult to obtain, vocational training is difficult to carry out, and the right of occupational protection is difficult to exercise.
