【摘要】 社区矫正在犯罪惩治体系中占有非常重要的地位,而社区矫正风险评估作为社区矫正工作的关键一环,具有重要的意义和作用。如何充分考虑我国各省市地区的经济、政治、文化发展不平衡情况,从国家层面高度进行包含社区矫正风险评估的正式立法,是当前法学领域的热点研究问题之一。本文在对我国当前社区矫正风险评估立法规范探析基础上,借鉴国外社区矫正风险评估立法经验,对我国的社区矫正风险评估的立法模式、立法效力、评估主体、监督机制等提出对了相关立法建议和思考,从而为我国社区矫正工作的进一步发展提供指导和理论支撑。更多还原

【Abstract】 Community correction occupies a very important position in Chinese crime punishing system.As one of the key parts of community correction,community correction risk assessment has very important significance,so considering fully the imbalance of economic,political and cultural development in Chinese provinces and cities,how to construct a community correction risk assessment system and its relevant legislation become a very hot academic research problem in the field of law now. On the basis of analyzing of the current legislation of risk assessment of community correction,combined with the legislations of foreign community correction of risk assessment,this paper puts forward the relevant legislation method and suggestions on the legislative model,legislative validity,assessment subject and supervision mechanism of community rectification risk assessment,so as to provide guidance and theoretical support for the further development of community correction work in our country.更多还原
