【摘要】 针对目前我国高校专利拥有量大、转化实施不足的现状,西南交通大学率先采用专利权的混合所有制的运营模式,将职务发明创造的专利权由高校与发明人共同所有,促进专利实施效果明显。专利权的混合所有制运营模式在现行的法律框架下,具有合理性和合法性。为了发挥其积极作用,在实际操作层面上,宜采取自愿申请的原则,防止滥用,程序上应规范化、公开化。更多还原

【Abstract】 There are large amount of patents owned by universities in China nowadays. But these patents could rarely be exploited. In order to promote patent exploitation, Southwest Jiao Tong University adopts the model of mixed ownership of patent right. It allows patent right of on-duty invention owned by the University and the inventors. The effect of promoting patent exploitation is obvious. Under the current legal framework of China, this model is reasonable and legitimate. In order to give full play to its positive function, the principle of voluntary application should be adopted in the actual operation level to prevent abuse and the procedure should be standardized and published.更多还原
