【摘要】 研究目的:中国农地信托制度对农地所有人实行偏向性保护,直接导致农地信托制度运行中的权利失衡,需要对现有权利进行重新配置。研究方法:法律实证分析、比较分析、法律解释。研究结果:(1)中国当前农地信托中存在权利失衡现象;(2)农地信托权利失衡的原因在于立法对信托人的过度保护;(3)农地所有权、自主管理权和收益权的分离运行是实现权利重构的方向。研究结论:中国农地信托应当在信托财产独立的前提下,将农地信托人主体权利从控制性转向监督性。更多还原

【Abstract】 Abstrct: The purpose of this paper is to analyze rights imbalance of rural land trust in China and to reconstruct the right structure. Methods employed include legal empirical analysis; comparative analysis; legal interpretation. The results show that: 1)rights imbalance existed in our current agricultural land trust; 2)rights imbalance is caused by excessive protection of the trustee rights; 3)separated operation of rural land ownership, independent management and income right are the targets of the rights reconstruction. The paper concludes that we should transform the legal status of rural land trust, complete the fiduciary duties of rural land trust, improve registration and publication system, set up "puncture" mechanism for creditors and tax collectors as well as complete auditor system, etc.更多还原
