【摘要】 随着信息化社会和全媒体时代的到来,信息的形式越来越多样化,信息生产、传播机制发生变化,给天生以信息传播为核心的虚假信息犯罪插上了"腾飞的翅膀",严重影响了社会稳定,扰乱了社会秩序,并且呈现出泛滥之势。然而能够纳入刑法评价视野的"虚假信息"范围过于狭窄,只限于"虚假恐怖信息",现行刑法应对网络虚假信息犯罪的滞后与缺陷日益凸显。司法上,需要通过法定程序进行扩张解释以满足司法实践的需求;立法上,应当对编造、故意传播虚假恐怖信息罪进行修正,扩大其适用范围,从仅制裁虚假的"恐怖信息"扩展到制裁所有"严重危害社会秩序和国家利益"的"虚假信息"。更多还原

【Abstract】 With the informatization of society and the advent of Era of convergence media,the form and carrier of information is more and more diversified,information production and transformation mechanism have been changed,the false information crime of the natural information transmission as the core is plugging in the wings of "boom",seriously affected the social stability,and disturb the social order,presenting the trend of the flood. However the range of "false information"evaluated in criminal law is too narrow,limited to "false terrorism information",the current criminal law dealing with the cyber false information crime is lagging and defects have been revealed. In the justice,expanding judicial interpretation through legal procedures is required to meet the needs of judicial practice; In the legislation,the crime of fabricating and deliberately spreading false terrorism information should be amended,expanding its scope of application,from sanctions only false "terrorism information"extended to all the "serious damage to the social order and national interest"of"false information".更多还原
