【摘要】 英国土地法悖论是英国土地法发展过程中一个独特历史现象,其核心是一个传统的土地法实现着调整现代法律关系的功能,这看似与我们熟知的法律与经济互动理论相悖。事实上,英国土地法一边保留着传统性,一边通过具有弹性的制度设计,较好实现了社会经济快速发展对法律效率以及新兴法律主体土地权益维护方面的调整需求。由于其关涉社会生活中基础法律制度与社会经济发展的关系这个法律研究中的根本问题,解读英国土地法悖论现象,无疑对当代中国土地法改革具有启发意义。更多还原

【Abstract】 British land law still kept its feudal roots until 1925 reform of land law,which nevertheless,did not hinder economic development of Britain. It is surprising that the feudal legal system could achieve the goal of regulating the basic legal relationship in the country with the rapidest development in early modern times. Scholars named this strange phenomenon as the Paradox of British Land Law. In fact,basic legal relationships are regulated by British feudal land law with a highly elastic legal system which met the needs of legal efficiency and maintenance of land rights. Such phenomenon concerns with identifying the relation between law and economy,so it is also of great significance from the historical perspective to explore the paradox of British land law by analyzing its nature,reasons of its emergence.更多还原
