关系契约的缔结与海洋分割行政治理——以珠江口河海之争为例
Relational Contract Processing and Divided Regulations Governance: a Case Study of Conflicts between the River and Sea Departments at the Pearl River Estuary
【摘要】 海域管理是一个新兴的区域公共管理领域,但在管理体制分割、法律制度分割、行政管制分割的制度环境下,我国的海域管理面临着突出的分割行政境地。对珠江口河海之争的案例研究表明,水利部门联盟与海洋部门联盟通过缔结关系契约,逐步缓解了分割行政导致的部门间内在的紧张和冲突,并有利于海域公共管理整体绩效的提升;而外部环境的分层嵌入和组织间的互动交易是关系契约形成的主要机制,这些嵌入性因素主要包括立法机关、社会力量、官僚亚系统和行政结构等方面。
【Abstract】 Sea area management as a whole is an emerging field of regional public administration. However, an intricate pattern of governing the fragmented regulations over the sea area at the Pearl River estuary has been formed in the long run by the factors such as fragmented legal systems, regulatory regimes, department stand, and admin-istrative control. With the case study of the conflicts between the water conservancy department and the sea management department at the Pearl River estuary, this paper shows that water conservancy sector alliance and the marine sector alliance have gradually eased the intergovernmental tensions and conflicts derived from frag-mented regulations, and enhanced the overall performance of the sea area management. Moreover, multiple em-bedded factors including systems of law, administrative construction, cultural cognition, and social forces are the important mechanisms for constructing the relational contract among different administrative departments.
