【Abstract】 Fine penalty belongs to the category of property punishment,and it is the supplementary punishment relative to the principal punishments. When it is applied together with the principal punishments,it has both the function of supplementing the principal punishments and the function of adjusting the intensity of principal punishments. When it is applied separately,it has the nature of the principal punishments,bearing the function of independently balancing the crime and the responsibility. The basis of the application of fine is the circumstances of sentencing and the property status of the offender. It is therefore important to distinguish the convicted facts and the circumstances of the sentencing in order to make it more reasonable to apply the fine penalty and meets the requirement of the judicial idea of specifying. It will help to exert the function of the fine penalty to prevent crime and to prevent the excessive punishment of criminal offences if the judges be given more discretion in the application of fine.更多还原
