【摘要】 立法背景资料所具有的魅力就在于其所具有的二元性,能够打通立法与司法的实务领域和学术研究的理论领域。通过找寻立法背景资料进行妥当地运用是区分专业人员与普通民众的重要评判标准。运用立法背景资料时,从立法论角度出发,立法者需要围绕建议者的意见所形成的价值判断结论和理由作为可供批判和论证的依据,通过权力来获取最低限度的共识;从解释论角度出发,法官需要围绕立法者的实定法文本与立法背景资料进行解释并可作为未来修法的依据,通过权力来获取最大限度的共识。找寻立法背景资料时,在区分记录者记载的文本资料与讲解者录制的声像资料的基础上,会有不同的找寻路径和方法。运用立法背景资料所得到的启示为欲建设和完善智慧型、智能型、智库型法院,法官应做立法者的思想助手;找寻立法背景资料所得到的启示可以从认知、整理、公布三个方面着手,立法法应对立法背景资料予以规范化。更多还原

【Abstract】 The duality is charm to data of legislative background. The data of legislative background can open up the field of legislation and judicial practice in the field and academic research. By looking for the data of legislative background and properly used is an important criterion to distinguish professionals and ordinary people. When using the data of legislative background,from the perspective of legislation,legislators can criticize and argue the value proposition of the conclusions and reasons which is proposed by suggesters. Legislators need to obtaining minimum consensus through the power. From the perspective of interpretation of legislation,judges need to apply the law by the positive law text and data of legislative background and his work record can be used for amending the law for the future. Judges need to obtaining maximum consensus through the power. When looking for data of legislative background,on the basis of distinguishing recorder described in text form and explain those recorded on audio and video materials,we will have the different paths and methods. The enlightenment is that judges should be the ideological assistant of legislators for building intelligent court,when using the data of legislative background. The another enlightenment is that the data of legislative background from three aspects of the cognition,arrangement and announcement should be standardized by legislation law,when looking for the data of legislative background.更多还原
