【摘要】 目前我国循环经济执法主要存在政府应为而不为和过分而为,循环经济立法保障滞后、硬法保障机制不足,执法体制和执法者自身素质有限、导致循环经济执法不力,公众基础薄弱等问题。因此,创新循环经济执法保障机制,完善循环经济立法、促进循环经济执法保障机制完善,确定循环经济执法主体、明确责任划分,贯彻公众参与机制等是完善循环经济执法保障机制的有效对策。同时,要将必要的立法、司法、技术、监督与行政指导结合传统的行政强制融入循环经济执法机制中,结合市场规律与循环经济发展规律,突破传统执法固有的缺陷,完善循环经济执法保障机制,为循环经济的发展和生态文明的建设保驾护航。更多还原

【Abstract】 At present,the development of China’s circular economy is plagued with multiple problems in terms of law enforcement,legislative guarantee,and public awareness. Therefore,efforts should be made to probe into ways of improving the law enforcement mechanism of China’s circular economy,which,as is argued herein,include enhancing the law enforcement capacity,improving the legislative system,formulating clear accountability mechanism,and boosting public awareness. At the same time,in order to sustain the sound development of China’s circular economy and promote ecological civilization,it is incumbent upon relevant authorities to accommodate all possible contributing factors in their efforts to improve the law enforcement mechanism of China’s circular economy in line with the inherent laws of both the market and the development of circular economy.更多还原
