【摘要】 确立和保障农民金融发展权,是立宪国家的基本义务。农民金融发展权具有基本人权属性,国家宪法及相关法律对这一权利的承认和保障,不仅有利于农民自身的发展,而且有利于国家金融体制的持续、健康发展。国家应从公共产品提供者、市场秩序规制者以及金融市场宏观调控者的角度去设定与履行其实现农民金融发展权的基本义务,并在立法、司法上构建相应保障机制。更多还原

【Abstract】 It is the fundamental state obligation of constitutional states to establish and ensure the financial development rights of farmers which has the nature of human rights attribute.The acceptance and protection of the financial development rights of farmers by the constitution and the relevant laws and regulations is not only conducive to farmers’ self-development,but also beneficial to the sustainable and sound development of the national financial system.The state should set and perform its obligations to realize farmers’ financial development rights from the standpoint of the supplier of public products,and the macro-regulator of financial market,and establish a Security System in the legislation and justice.更多还原
