【摘要】 反恐立法要正确处理反恐与人权保障的平衡关系。反恐的根本目的在于保障基本人权,但是,反恐活动为提高防范和打击恐怖主义效率而采取的特别法形式又往往导致公权力过度扩张。因此,为保障基本人权需要在目的、方式、程序等方面对反恐活动作出必要的限制和约束。反恐活动应遵循合法性原则、综合治理为本原则、禁止歧视原则、比例原则等行为规则,防止反恐活动走向其自身目的的对立面,引起人权危机。更多还原

【Abstract】 The anti-terrorism legislation should correctlly handle equilibrium relationship between anti-terrorism by law and human rights protection.The fundamental aim of anti-terrorism is to guarantee basic human rights, however,the form of special law taken in anti-terrorism activities to improve the efficiency of preventing and combating terrorism often leads to excessive expansion of public power. Therefore, in order to guarantee basic human rights, we need to make necessary restrictions and constraints for anti-terrorism activities, in such aspects as the purpose, ways, and procedures. We shall comply with behavior rules, such as the principles of legality, the principle of comprehensive treatment, the principle of prohibiting discrimination, proportion principle and so on, so as to prevent anti-terrorism activities towards the opposite of its own purpose, causing the crisis of human rights.更多还原
