【摘要】 无效合同制度维护社会公共利益的宗旨能否有效发挥,与其时效规则的适用紧密关联。无效合同时效规则的适用主要涉及确认合同无效以及无效合同确认后请求权两个方面,但目前我国法律对此却付之阙如。从解释论的角度分析,对确认合同无效予以一定除斥期间的限制较为合理。无效合同确认后主要产生返还原物请求权、不当得利请求权和赔偿损失请求权,关于其相关时效规则的适用,则要区分原物是否存在以及请求权的性质分别对待。更多还原

【Abstract】 The author holds the time rule matters in that the invalid contract system works in maintaining the social and public interests.Invalid contract limitation rule is mainly related to confirming the contract null and void contract confirmation request in two aspects,but the current law of our country has not been improved in this regard.From the perspective of the interpretation theory,the author analyses the contract null and void and holds that the limit of the period is reasonable and the invalid mainly produces the return of the original claim,unjust enrichment and the right to request compensation for the loss of the right to request.In terms of applicable rules,the author distinguishes the original existence and the nature of the right to request to treat them separately.更多还原
