【摘要】 应用模型分析法和制度分析法,研究了失地农民与地方政府在农地非农化过程中的利益关系,从博弈论角度探析失地农民权益受损的原因和依法维权的内在机理。应规范地方政府施政行为,强化权利监督约束机制;搭建多渠道诉求平台,降低维权成本促稳定;科学分配农地增值收益,健全农村社保就业体系;健全土地法律法规,创新农地产权制度等路径来确保失地农民权益,从而促使处于劣势地位的失地农民在与地方政府博弈过程中,权益更加趋于合理均衡。更多还原

【Abstract】 Adopting the model analysis and institutional one to study the benefit relationship between land-loss farmers and their local governments in the process of non-agricultural conversion of farmland,the paper explores the reasons for the interest damage of land-loss farmers and the internal mechanism for safeguarding their legal rights. The administrative behaviors of local governments are supposed to be regularized to strengthen the supervisory and restraining mechanisms for rights. A multi-channel appealing platform is expected to be constructed to lower the cost of safeguarding rights and promote stability. The value-added income of farmland should be allocated scientifically to improve the rural social security and employment systems. And such approaches as developing the land law and regulation as well as innovating the system of farmland property rights and so on are recommended to ensure the rights and interests of land-loss farmers so as to secure the more reasonable and balanced rights and interests for the disadvantageous land-loss farmers in the game with their local governments.更多还原
