【摘要】 从"法"、"法治"、"合法性"这三个相互关联又逐层递进的概念出发,重新审视和思考韩非子政治思想的意义和价值。韩非子的"法"只在极为狭窄的意义上可以和现代政治学中的"法律"重合。韩非子政治思想中"法制"有余,而"法治"缺席,前者损害后者。韩非子对政治合法性问题也未给出令人信服的答案。因此,韩非子的政治思想对于我们时代的意义主要在于批判和反思,而非直接运用。更多还原

【Abstract】 This paper reexamines and reflects on the significance and value of Han Feizi’s political thought based on three related and progressive concepts—"law","rule of law"and "legitimacy". As is discovered,Han Feizi’s "law"is coincidental with the "law"of modern politics in a narrow sense,for in Han Feizi’s political thought "rule by law"is overemphasized while "rule of law"is underemphasized,thereby resulting in the damage of the former to the latter. Moreover,Han Feizi has not given a convincing reply to the problem of political legitimacy. Therefore,the significance of Han Feizi’s political thought lies in its criticism and reflection rather than its direct application in the modern era.更多还原
