【摘要】 制止自杀行为从刑事政策、司法实践、刑法"二次规范"地位、我国罪刑配置来看都不应当处罚。如果采"自杀合法说",制止自杀的出罪只能从"紧急避险"、"推定承诺"等角度寻找根据,但因为"自杀合法说"将自主决定权奉为圭臬,通过阻却违法出罪并不可行。参与自杀从刑事政策、司法实践、体系内部协调、各国立法来看具有可罚性,而如果采"自杀合法说","单一正犯体系说"或"不作为犯"的入罪体系存在缺陷。自杀既非合法行为,也非法外空间,可以在家长主义找到其违法依据。之所以不处罚自杀行为,不是因为其不具有"可罚违法性",而是不具责任。承认自杀的违法性,可以妥善解决制止自杀行为的出罪问题与参与自杀行为的入罪问题。更多还原

【Abstract】 The behavior of stopping committing suicide should be legal from the angle of criminal policy,juridical practice,’second punishment’nature of criminal law and the set of crime and punishment. If we agree with the theory of legal suicide,the decriminalization of stopping committing suicide can only be reasoned from the theory of urgent danger prevention and commitment. However,if we put the right of making decision by oneself in the first place,the decriminalization of stopping committing suicide can be hard. Involving in suicide is illegal from the angle of criminal policy,juridical practice,balance of the system and foreign legislation. Suicide is not legal or out of law and the base of its illegality can be traced from paternalism. The reason of not punishing suicide is not because it cannot be punished,but because of the lack of responsibility. Once we admit suicide is illegal,the decriminalization of stopping committing suicide and criminalization of involving in suicide can be explained easily.更多还原
