【摘要】 法国未成年人不起诉制度具有适用范围较宽配套考验机制较完备等特征。我国2012年3月14日修订后的《刑事诉讼法》规定了未成年人附条件不起诉制度,体现出我国刑事司法对未成年人权益保护的加强。本文通过对法国未成年人不起诉制度特征的分析,探讨了我国未成年人附条件不起诉制度在适用范围、与其他不起诉制度的区分、考察制度配套建设等方面存在的问题及其相应的完善措施。更多还原

【Abstract】 The non-prosecution system of minors in France is characterized with wide scope of application and complete mechanism of corresponding testing. On Mar. 14,2012 China’s Criminal Procedure Law was amended,which specifies the conditional non-prosecution system of minors and shows Chinese judicial emphasis on the protection of minors’ rights and benefits. This paper makes an analysis of features concerning the French non-prosecution system of minors,explores the Chinese counterpart in terms of application scope,difference from other non-prosecution systems and problems related to the corresponding system development,and makes suggestions for improvement.更多还原
