【摘要】 标准必要专利(Standard-Essential Patents,SEPs)的公平、合理、无歧视(Fair,Reasonable and Non-discriminatory,FRAND)许可是当前学术界、实务界共同关注的前沿问题。本文基于8个通信领域标准必要专利典型案件的诉讼判决书,利用多案例研究、专利文献计量分析、内容分析等方法,识别了标准必要专利及其统计特征,明晰了FRAND准则的核心内涵,得到FRAND许可定价的影响因素,据此指出标准必要专利的FRAND许可定价应考量"专利贡献价值",并提出了FRAND许可定价路径。研究结论可为政府、法院、企业等利益相关方提供决策参考。更多还原

【Abstract】 The FRAND(fair,reasonable and non-discriminatory)licensing of the standard-essential patents is a frontier issue of both academia and industry.The research focuses on eight typical cases about standard-essential patents in the communications world,using multi-case study,patent-bibliometric analysis method and content analysis method based on the litigation judgments,identifies the SEPs and their statistical characteristics,and clarifies the core connotation and main factors influencing the FRAND licensing.This research further proposes that the reasonable licensing shall measure"contribution value"of standard-essential patents and points out the pricing path of licensing.The results can provide reference for the governments,courts,companies and other organizations.更多还原
