【摘要】 英国作为普通法传统的典型国家,对提高现代欧洲的人权与法治保障水平作出了独特的贡献。英国在反对家庭暴力中独特的法律定义方法,在不规定单独家庭暴力罪的情况下通过各种手段增强对家庭暴力的压制程度,以"占领令"和"禁止骚扰令"为核心反家暴民事责任紧密地与以逮捕和藐视法庭罪为核心的刑事责任相结合,以及以组建"家庭暴力专家法庭"与"综合性家庭暴力法庭"为标志的反家暴司法体制改革,对我国反对家庭暴力的法制建设工作提供了可借鉴的学术支持。更多还原

【Abstract】 United Kingdom has made unique contribution to promoting the level of human right protection and rule of law by its typical common law tradition. UK ’s experiences may provide helpful academic support to the legal construction against domestic violence in China in terms of its unique definition of domestic violence,the way of increasing suppression domestic violence by various legal instruments without specific offence of domestic violence,the close connection of civil liability centralized by Occupation Order and Non- molestation order to the criminal liability centralized by arrest and contempt of court,as well as the British reform of justice system marked by the special tribunals in fighting against domestic violence.更多还原
