【摘要】 单凭国家立法展开的法治实践对社会秩序化需求的满足具有不可克服的天然局限性,主要包括国家立法在内容上的限度和调整机制的滞后两大方面。因此国家立法不能否定和完全替代社会自我生成秩序的能力。社会组织是社会自我秩序化的现实践行者,它在自我内部追求理性行动和组织秩序,同时在外部为国家与社会的交互作用提供良性且有效的机制,进而缔造出健康而非压制的社会秩序。中国法治成长的真正本土资源来自于市场经济条件下社会主体的经济交往活动和社会组织的自治行动,其最直接的资源载体就是由各类社会组织缔造的非正式制度。以社会组织为主体充分发挥社会自我秩序化功能,是法治秩序实现的有效路径,也是弥补我国政府推进型法治的动力单一性缺陷的必要选择。更多还原

【Abstract】 Depending solely on national legislation,the innate limitation of rule of law practice for satisfying the demand of promoting social order is insuperable,which includes the limits on the contents of national legislation and the delay of the legal regulation system. Therefore,national legislation can never deny or completely substitute the ability of the society to generate order by itself. Social organizations,which are the practitioners of the social order,seek rational action and order inside and meanwhile provide a positive and effective mechanism for the interaction between the country and the society outside,and thus create a healthy rather than repressive social order. The native resources for the development of Chinese nomocracy originates from economic activities of social subjects and the autonomy of social organizations,the most direct carrier of it being informal system made by social organizations of all kinds. Making full use of the social ability to generate order by itself with social organization as its main body is an effective way to form rule of law order and a necessary option to compensate for the defects of a single driving mechanism for the nomocracy promoted by the Chinese government.更多还原
