【摘要】 近百年的大国之争,其核心是国家创新体系之争。国家创新体系的本质只有一个:即一种科学技术长入经济增长过程之中的制度安排。今天的中国,以集中力量推动技术发明创造的模式遇到了瓶颈,必须寻找释放创新活力的新动力源。以知识产权法律制度为主导的创新模式能够有效解决国家主导模式下研发成果与产业化应用之间脱节的弊端,是促进科学技术长入经济增长过程之中的最佳制度安排。当代中国决策者要充分认识到,当最广泛程度上的市场主体都依赖知识产权制度而非权力寻租等手段从事竞争之时,方是创新型国家建成之日。未来的知识产权世界,必将为不同力量所主宰,影响并决定着国家经济发展的命运。要深入考察这些潜在力量,了解知识产权法律制度所应承担的历史使命,制定正确的应对策略,确保知识产权系统良性运转,为释放占世界1/5人口的创造活力和建设创新型国家起到积极的推动作用。更多还原

【Abstract】 The contention of national innovation system is core of national competition. The nature of the national innovation system is the institutional arrangements which transfer science and technology into economic growth. At present time, the pattern which concentrates on the promotion of technological invention has hit a bottleneck, which needs to fi nd a new power source for the release of creative energy. As a code of conduct for intellectual thought oceans, intellectual property(IP) law provides a sophisticated power plant for production and configure of innovation resources. The innovation model which dominated by intellectual property legal system could address the gap between research results and industrial applications under the national dominant mode, which is the best institutional arrangements to promote science and technology to grow into the process of economic growth. Nowadays, Chinese policy makers should fully understand that when and only when the widest degree of market players are dependent on the power of the IP system rather than seeking other means to engage in competition, it is the time the innovative country has been built. The future of intellectual property in the world is surely dominated by different forces, infl uencing and determining the fate of the country’s economic development. It is suggested to further investigate these potential forces, understand the historical mission of intellectual property legal system, develop the right coping strategies to ensure the healthy functioning of the IP system, help to promote the creativity and innovation of China, which accounting for 1/5 of the world’s population.更多还原
