【摘要】 在行政执法中引入协商机制是建设服务型政府的需要。协商式行政执法有助于减少行政纠纷的发生和提高行政效率及公众认可度。我国传统文化中的"和为贵"思想为协商式行政执法提供了文化支撑,法律法规中的相关规定与行政活动的广泛实践为协商式行政执法奠定了现实基础。为了防止对协商式行政执法的滥用,需要从适用范围、基本原则及监督机制等方面对其予以规制。更多还原

【Abstract】 The consultative mechanism introduced into the administrative law enforcement is the need of constructing service-oriented governments.The consultative administrative law enforcement contributes to decrease the happening of administrative disputes and to enhance the administrative efficiency and the public recognition.The idea of "harmony is the most precious" in our country’s traditional culture offers the cultural sustainment to the consultative administrative law enforcement,and the relevant stipulations of laws and regulations as well as the extensive practice of the administrative activities lay the realistic foundation for the consultative administrative law enforcement.In order to avoid abuse of the consultative administrative law enforcement,it needs to offer regulations from aspects of the application scope,basic principles and the supervision mechanism and so on.更多还原
