【摘要】 改进专利是促进社会创新、应对专利垄断行为的有效途径,它具有进步性、相对独立性和针对性三种特征,而通过研判相关案例和法条,又可以抽象出增加、减少、改进必要技术特征以及要素组合四种改进专利类型。为妥善解决改进专利同基本专利不同所有权人之间的利益矛盾,应在明确权利归属、避免专利侵权的基础上,通过购买、协商许可和强制许可来完善相应的专利实施技术路径。更多还原

【Abstract】 Improved patent is an effective way to counter the problem of patent monopoly and promote innovation. In consideration of the insufficiency in the practice of and research on improved patent,systemic theoretical research is of great significance,and a complete theoretical model needs to be built. Improved patent has progressiveness,relative independence and so on. Through comparison and inductive methods,its connotation is further clarified. Improved patent covers four types including the ones of increasing,reducing and improving the necessary technical characteristics. In the implementation of improved patent,to handle the difficulties resulting from the complex relationship between improved patent and basic patent,effective countermeasures can be taken in practice including the attribution of right,the application of inverse equivalent principle,patent licensing and so on.更多还原
