【摘要】 为明确沟域经济与法治之间的内在联系,笔者就沟域经济法治保障的核心问题展开分析和论述,从而对沟域经济法治保障的必要性和重要性进行理论阐释和论证,以期对沟域经济理论体系的丰富和完善有所助益。北京沟域经济发展的实践经验和相关理论研究表明,有关沟域经济法治保障的研究尚存在明显的不足之处。笔者将沟域经济作为一种经济社会现象,并在有关沟域经济既有研究的基础上,运用整体解释的方法,从社会现象和制度规范的角度对沟域经济进行了重新解释。沟域经济在本质上属于农村经济,具有区域经济的属性和强烈的地域性特征。在此基础上,笔者对沟域经济的法治意涵及其对法治的客观需求进行分析和论述,同时重点讨论了沟域经济法治保障的必要性及其2个核心问题——政府在沟域经济中的地位与作用、农民的权益及保障。通过论证和分析,明确了沟域经济法治保障理论研究的重要意义。更多还原

【Abstract】 To clarify the inner relation between the valley economy and rule of law, this article analyzed anddiscussed the core problems about the protection of law in valley economy. The necessity and importance ofprotection of law in valley economy which contributed to enrich the theory system of valley economy werecarried out theoretically through related explanation and demonstration. The practice of valley economicdevelopment in Beijing and related theoretical researches showed that there was obvious deficiency in thestudies about the protection of law in valley economy. In this article, valley economy was regarded as aneconomical and social phenomenon and was reinterpreted using the method of whole explanation on the basisof the researches in the past from the perspective of social phenomenon and standardization of the system.Valley economy belonged to the rural economy in essence, and had the attributes of regional economy andintensive regional characteristics. On this basis, this article tried to settle the nomocracy meaning of valleyeconomy and its objective demands to rule of law. At the same time, necessity of protection of law in valleyeconomy and its two core issues which were the position and role of government and the rights protection ofpeasant were discussed. The important significances of theoretical researches about the protection of law invalley economy were clarified through the argumentation and analysis.更多还原
