【摘要】 拉努湖仲裁案是国际环境法中关于水资源利用和管理的著名案例,陕西省水权制度虽然有异于案例中主权国家的水权制度,但其所确认和彰显的国际环境法基本原则、水资源利用和管理理念以及水资源法律精神影响至今。在分析陕西省水资源和水权制度现状的基础上,结合拉努湖仲裁案的经验,提出"北用南补"水权优化思路。更多还原

【Abstract】 Lake Lanoux Arbitration is the famous case of utilization and management of water resource in international environmental law.Although water right system in Shaanxi Province is different from water right system of the sovereign state in the case,it has a great influence and it is worth learning and using for reference to water right system in Shaanxi Province that confirmations and reveals the basic principles of international environmental law,water resource utilization and management ideas,and law spirit of water resources.Based on the analysis of the present situation of water resources and the water right system in Shaanxi Province and the experience from Lake Lanoux Arbitration,the paper puts forward the idea of optimization of water right,namely " the north use water and the south fill water".更多还原
