【摘要】 我国公立高校外部行政管理权力包括政校间基于行政隶属和基于行政管辖的两种权力形态。行政权力法治化既是法治框架下政府与高校间权力关系的一种理性样态,也是关系主客体通过法治途径努力实现这一愿景的机制、方式与过程。当下,我国公立高校外部行政权力的法治化遭遇着权力本位思想束缚、行政化运行机制和程序要件普遍性缺失的内在困境。解决的路径在于:积极推进府际分权管理、高等教育"清单管理"和公立高校法人制度的法治化重建,以此推进公立高校外部行政的程序治理。更多还原

【Abstract】 External administrative power in China’s public colleges and universities can be divided into two types: the power between government and colleges/universities based on administrative subordinate and that based on administrative jurisdiction. The legalization of these powers is not only a rational state of external administrative power relationship in colleges and universities under law frame, but also a kind of mechanism, mode or process to realize this ideal vision. In the current social environment, the legalization will be faced up to power-oriented ideology, administrative operating mechanism,and the lack of governance in accordance with procedures. Therefore, its road lies in the legalization of decentralized administration among governments, institutionalization of "inventory management" between government and universities,reconstruction of the legal system of colleges and universities, and promoting governance through statutory procedures.更多还原
