【摘要】 澳门博彩债务是博彩者在澳门参与博彩过程中因违反筹码买卖合同和博彩信贷合同而应承担的金钱偿还义务。对博彩债务的司法追偿是内澳两地司法合作的重要内容。文章着重讨论了澳门博彩债务在内地的追偿问题,内容分为四个部分:第一部分对澳门博彩债务的内涵、外延以及法律性质做了深入分析;第二部分对澳门博彩债务在内地的司法追偿情况作了一定程度的调查和总结;第三、四部分着重论述内地法院在澳门博彩债务追偿诉讼中的法律适用问题以及与此相关的公共秩序保留问题,然后在此基础上提出了问题的解决之道。文章的核心观点是:内地在澳门博彩债务追偿诉讼中宜适用澳门法律而不是内地法律,内地在澳门博彩债务追偿执行中应当限制适用公共秩序保留原则。更多还原

【Abstract】 The gambling debts in Macao originate not from betting,but from the trading of chips as well as the lending of gambling-loan. At present,the recovery of such debts has become an important aspect of the judicial cooperation between Macao and China’s mainland. This paper first clarifies the connotation,denotation and legal features of gambling debts. Then it surveys the current situation of judicial recovery of gambling debts on China’s mainland. It also discusses the application of law for sustaining public order in this regard.The author’s point is that courts on China ’s mainland should cite Macao law when deciding such cases and restrict the reservation of public order when executing court decrees in Macao.更多还原
