【摘要】 党的十八届三中全会首次指出市场在资源配置中起决定性作用,为政府与市场的关系作出了新的定位。本文以《中华人民共和国反垄断法》对行政垄断行为的规制为切入点,从市场秩序的有序与无序状态、政府与市场的关系对市场秩序的影响等角度,探讨了政府的多重角色,并在此基础上提出了我国政府在当前市场秩序管理中的正确定位:立足市场服务与监管,以维护市场秩序为其重要职责,从而建立服务型的、有限的法治政府。更多还原

【Abstract】 On the Third Plenary Session of the 18th Committee of the Communist Party of China,it was pointed out that market plays a decisive role in resources allocation,which redefined the relationship between government and market. The paper probes into the multi-roles of government based on the regulation of administrative monopoly in the Anti-monopoly Law and a discussion from the perspective of both orderly and disorderly market and the relationship between government and market. The paper also aims to explore the proper positioning of government in the current market order management,it should shoulder the responsibility for maintaining the market order based on market service and supervision,and establish a service-oriented,limited government under the rule of law.更多还原
