【摘要】 以TPP协议下首个林业协议——美国-秘鲁林业协议为例,分析了TPP可能对林业及我国林业发展带来的影响。研究发现:美国-秘鲁林业协议具有突破性意义,它不仅使环境议题进入贸易谈判领域,而且通过贸易规则的制定,形成对贸易国尤其是发展中国家国内行政管理机制、法治建设等强有力、实质性的干预和改进,充分体现了新型、高水平自由贸易协定的特点。在环境、劳工等非传统安全议题进入自贸谈判的形势下,应引起我国林业及相关部门的高度重视。同时,在党的十八届四中全会确定的依法治国总体改革思路下,林业协议的部分内容也可以为我国《森林法》修订以及森林资源管理体制改革提供参考。更多还原

【Abstract】 Taking American-Peru forestry agreement(Forest Sector Governance),the first forestry agreement under TPP,as an example,the paper analyze possible impact of TPP on forestry and Chinese forestry development.It was found that the agreement is breakthrough for forestry.The agreement not only bring environmental issue into trade agreement,but also strongly intervene governance,legislation of developing trade country through trade regulation,fully demonstrating TPP’s new and high level free trade feature.China should pay high attention to the agreement especially under the increasing trends of non-traditional security issues such as environmental,labor,etc.into free trade negotiation.In the meantime,the agreement could be reference to the revision of‘Forestry Law’and China’s forest resources management reform in line with general reform framework of the rule of law which was set up by the eighteen session of the fourth plenary session.更多还原
